The lawyers of The Health Law Firm routinely provide legal representation to nurses in a variety of different situations.  If you receive notice that the Department of Health has opened a Board of Nursing investigation against you, contact The Health Law Firm before you talk to an investigator.

Our attorneys include those who are board certified in health law by The Florida Bar, those who are nurses themselves, and those who are licensed health professionals.  Each of our attorneys is a member of The American Association of Nurse Attorneys (TAANA).  Our attorneys represent nurses at formal administrative hearings at the Division of Administrative Hearings (DOAH) in defense of administrative complaints and in informal hearings before the Board of Nursing.

If you are accused of diverting drugs from a Pyxis, Diebold, or other brand of automated pharmacy dispensing machine, please contact us, immediately.  We are often contacted by nurses falsely accused of diverting narcotics, abusing narcotics, or stealing narcotics from patients.  We have represented nurses who have been fired, reported to the Department of health and reported to local law enforcement for criminal prosecution, even though they denied the charges and were negative on employer administered drug screenings.

We represent nurses, advance registered nurse practitioners (ARNPs), certified registered nurse anesthetists (CRNAs), certified nurse midwives (CNMs) and other health professionals in preparing, negotiating, amending, or breaking contracts.  We also represent them in preparing protocols, memoranda of understanding (MOUs), letters of intent (LOIs), and other business and commercial legal matters.

Our attorneys are also experienced in business and contract litigation, including defense against enforcement of restrictive covenants (sometimes called covenants not to compete or non-competition agreements).

We represent nurses in forming corporations and limited liability companies, in applications for home health agencies, nurse registries, health care clinics and other types of facilities regulated by the Agency for Health Care Administration (AHCA).  We also defend nurses in licensure and regulatory matters.

We do continue to strongly recommend that every nurse purchase nursing liability insurance with coverage for professional licensure defense, despite your employer.  See this article we have written on this subject.  We believe that it is even more important for nurses who work in nursing homes, hospitals and do traveling nurse work to have insurance.  Often it is the hospital, nursing home or other employer that reports the nurse and causes an investigation of the nurse to be initiated.  Nurses falsely believe that they have insurance coverage for such matters “through my employer” when they do not.  Often being able to afford an experienced health law attorney makes all the difference between losing a nursing license and a professional career and keeping them.

These are only a few of the many areas in which we provide legal advice and representation to nursing professionals.
